What is debt review removal?

According to the National Credit Act, debt review removal is possible if:
- All your debts under your debt re-arrangement agreement are settled, excluding a bond.
- You can prove that you are no longer over-indebted and can manage your debt obligations again.
This can become very frustrating. Many consumers find themselves in a position where their financial situation has drastically improved. This means they no longer need to continue with the process and do not need to have this status reflecting against their name any more.

What are the requirements for debt review removal?
You settled all your debts under debt review:
Suppose you have settled all your debts through the debt review process. Your Debt Counsellor must issue you with an official Form 19 Clearance Certificate. He will send this to all Credit Bureaus, and they will clear your status.
You settled all your debt under debt review in full, except a Home Loan:
You have settled all your debts through the debt review process, except for your home loan. Your Debt Counsellor must issue you with an official Form 19 Clearance Certificate. He will send this clearance to all Credit Bureaus, and they must then update your status. It would be best to pay your home loan as will be determined by your lender.
You have not settled all your debt under debt review, but you are no longer over-indebted:
If you have been under the debt review process but circumstances have improved to the point where you no longer need relief. You can apply to the court to have your debt review status removed. Your Debt Counsellor will not be able to help you with this. You will need to appoint an attorney to help you. If there is a debt review court order in place, this can not be be rescinded.
What is the process to get help with debt review removal?

- We will help you in making an application to the court to declare you no longer over-indebted. You must ensure you are in a financial position to do so.
- Should your debt review status be successfully removed, you will resume paying your original contractual agreements. Creditor/s are then free to enforce their rights regarding the credit agreement/s set out by the National Credit Act.
